Driving under the influence (DUI) is a serious crime with a conviction resulting in jail time and the loss of your license. There are two ways in which the prosecutor can attempt to prove this crime:
  • A blood alcohol concentration (BAC) of .08 or above, as measured by a breath or blood test
                               and/or
  • Your ability to drive was appreciably affected by alcohol or drugs

The penalties for a DUI conviction depend on several factors including, but not limited to the following:
  • The level of alcohol in your system
                               and/or
  • Whether you take the breath test
                               and/or
  • Whether you have had prior DUI convictions
